LONDRES (26 de setembro de 2025) \u2013 A BLOOM FRESH International Limited (BLOOM FRESH\u2122), uma das principais empresas de melhoramento de fruta premium do mundo, obteve mais uma vit\u00f3ria decisiva na It\u00e1lia em defesa dos seus direitos de propriedade intelectual. Ap\u00f3s anos de lit\u00edgios, o Tribunal proferiu uma senten\u00e7a definitiva a favor da BLOOM FRESH\u2122, condenando infratores reincidentes \u2013 j\u00e1 obrigados no ano passado a remover vinhas ilegais \u2013 ao pagamento de mais de \u20ac750.000 em indeniza\u00e7\u00f5es, custas e san\u00e7\u00f5es.

O caso teve in\u00edcio em 2020 com uma ordem de busca que resultou, em 2022, na apreens\u00e3o e injun\u00e7\u00e3o judicial, mas os r\u00e9us violaram repetidamente a ordem vendendo uvas n\u00e3o autorizadas, o que levou a den\u00fancias criminais. Em setembro de 2025, o Tribunal declarou que os r\u00e9us infringiram os direitos de obten\u00e7\u00e3o vegetal da BLOOM FRESH\u2122, ordenando n\u00e3o s\u00f3 a destrui\u00e7\u00e3o das plantas e materiais varietais ilegais, mas tamb\u00e9m o pagamento de indemniza\u00e7\u00f5es substanciais. O impacto financeiro total para os infratores ultrapassa os \u20ac750.000, incluindo danos, reembolso das custas judiciais e legais da BLOOM FRESH\u2122 e devolu\u00e7\u00e3o dos lucros obtidos ilicitamente.

Esta decis\u00e3o segue outras a\u00e7\u00f5es significativas contra o mesmo produtor. Em 2024, a BLOOM FRESH\u2122 anunciou a remo\u00e7\u00e3o for\u00e7ada de milhares de videiras ilegais em Bari \u2013 uma das maiores opera\u00e7\u00f5es desse tipo na hist\u00f3ria agr\u00edcola italiana.
