LONDRES (26 de septiembre de 2025) <\/strong>\u2013 BLOOM FRESH International Limited (BLOOM FRESH\u2122), una de las principales compa\u00f1\u00edas de mejora gen\u00e9tica de fruta premium, ha conseguido otra victoria decisiva en Italia en la lucha contra la infracci\u00f3n de la propiedad intelectual. Tras a\u00f1os de litigios, el Tribunal ha emitido sentencias firmes a favor de BLOOM FRESH, otorgando m\u00e1s de 750.000 \u20ac<\/strong> en concepto de da\u00f1os, costes y sanciones contra conocidos infractores reincidentes, quienes ya hab\u00edan sido objeto de una orden judicial para eliminar vi\u00f1as ilegales de BLOOM FRESH el a\u00f1o pasado.<\/p>

El caso comenz\u00f3 en 2020 con una orden de registro que dio lugar a una incautaci\u00f3n y medida cautelar en 2022; sin embargo, los acusados incumplieron repetidamente la orden vendiendo uvas no autorizadas, lo que dio lugar a derivaciones penales. Ahora, en una sentencia de septiembre de 2025, el Tribunal ha declarado que los acusados infringieron los derechos de obtentor de BLOOM FRESH y, adem\u00e1s de ordenar la destrucci\u00f3n de todas las plantas y materiales varietales restantes en infracci\u00f3n, los conden\u00f3 a pagar indemnizaciones sustanciales. El impacto financiero total para los infractores supera los 750.000 \u20ac<\/strong>, suma que incluye da\u00f1os, reembolso de los costes legales y judiciales de BLOOM FRESH, as\u00ed como la obligaci\u00f3n de devolver a la compa\u00f1\u00eda las ganancias obtenidas ilegalmente.<\/p>

Este fallo se suma a otras acciones significativas contra el mismo productor. En 2024, BLOOM FRESH anunci\u00f3 el arranque forzoso de miles de vi\u00f1as ilegales en Bari, una de las mayores operaciones de este tipo en la historia agr\u00edcola italiana.<\/p>

“<\/em> Esta sentencia hist\u00f3rica env\u00eda una se\u00f1al clar\u00edsima: infringir no sale rentable. Con pagos que ya superan los tres cuartos de mill\u00f3n de euros, junto con la destrucci\u00f3n de vi\u00f1as ilegales y \u00f3rdenes de publicaci\u00f3n, los tribunales italianos han demostrado que los derechos de propiedad intelectual en la agricultura son reales, ejecutables y conllevan consecuencias serias. Este resultado tambi\u00e9n se produce tras los intentos fallidos de asociados de los acusados de socavar los derechos de los obtentores mediante procedimientos antimonopolio infructuosos. Los tribunales han rechazado sistem\u00e1ticamente esas t\u00e1cticas, reafirmando el papel fundamental de la propiedad intelectual en la protecci\u00f3n de la innovaci\u00f3n, la inversi\u00f3n y la competencia justa en la agricultura.<\/p>
