<\/em>BLOOM FRESH today announced a <strong>decisive victory<\/strong> in China following a ruling by the <strong>Supreme People\u2019s Court (SPC)<\/strong>, which has upheld an earlier administrative penalty decision made by the Binchuan Bureau of Agriculture and Rural Affairs.<\/p><p>The action concerned a Yunnan-based target engaged in the unauthorised production, propagation and sales of the protected IFG Six grape variety, marketed under the trade mark SWEET SAPPHIRE\u2122 and the trade name Zi Yu Tian Zhu\/\u7d2b\u7389\u5929\u73e0<\/p><p>The SPC\u2019s decision brings closure to a multi-year infringement case involving large scale hectares of illegally planted IFG Six vines in one of China\u2019s most important grape-producing regions.<\/p><p>The judgment confirms that:<\/p><ul><li>The target infringed BLOOM FRESH\u2019s Plant Variety Rights<\/li><li>The fine issued by the local authority was correct and enforceable, and<\/li><li>The destruction of all propagating materials was lawful and appropriate.<\/li><\/ul><p>With the appeal dismissed at the highest level, <strong>the fine and penalty originally imposed by the Binchuan Bureau of Agriculture and Rural Affairs<\/strong><strong> will be fully enforced against the target<\/strong>.<\/p><p>\u201cThis ruling represents a decisive enforcement win and reinforces the strength of PVR protection in China,\u201d said Josep Estiarte, CEO of BLOOM FRESH. \u00a0<\/p><p>&#8220;We applaud the efforts of the local authorities to implement the PBR law and take action against infringements.
